TERMS & CONDITIONS
General
- “The Guest” are customers renting the property.
- It is the Guest’s responsibility to ensure that all members of his / her party accept the terms in these Terms & Conditions. Consequently, failure to disclose all relevant information or non-compliance with these Terms & Conditions leads to termination of the booking.
- Persons under twenty five years of age cannot make any bookings.
- We reserve the right to refuse a booking without providing a reason.
- We reserve the right to make reasonable amendments or additions to these Terms and Conditions without notice.
- To grant better enjoyment to the guest, respecting the property and its contents is mandatory.
- The booking confirmation grants a license to occupy the property between the agreed dates.
- We retain the right of access the property.
- All inventory items must remain on the premises.
Duration of Rental
- The “Booking Confirmation” email states the rental period.
- Bookings are on a weekly basis. Rentals commence at 4.00pm on the first day of the rental. And, end at 11.00am on the day of departure. Other arrangements are exceptional.
- Extensions to the rental period only by arrangement with us.
- The extension’s payment is due before the extension commences.
Booking and payments
- After your initial contact we send you a Booking Form to fill.
- To reserve the property please complete it without failing to sign it.
- Return the booking form by email to website@oasis16.pt
- At the same time, a non-refundable deposit of 30% of the total cost of rental is due.
- This deposit (or any other payment) is made by bank transfer.
- We send a confirmation email following receipt of the booking form and deposit.
This is the formal acceptance of the booking. - The outstanding balance is due five weeks prior to the Guest’s arrival date. At this instant the guest also pays the breakages deposit (see below).
- We cancel the booking when the Guest fails to pay the balance when due.
- We are not responsible for sending reminders of the full payment’s due date.
- Making a booking within four weeks of arrival date implies the payment in full at the time of booking.
Breakages deposit
- A refundable security deposit of 20% of the total rental value is due together with the outstanding balance payment. This is to cover any damage to the property, its contents or additional cleaning services.
- We refund the breakages deposit after departure, less the cost of damage / breakages.
- In making a booking, the Guest accepts responsibility for any theft, breakage or damage caused by him / her or any member of his / her party. He also agrees to financially compensate us for any loss that may incur as a result.
- The amount of the breakages deposit does not limit the Guest’s liability.
- In the event of a booking cancelation, the breakages deposit returns to the Guest.
- Subject to the Cancellations Policy below, as soon as the Guest receives the Booking Confirmation, he is liable for paying the rent’s balance. And, also any additional charges related to the rental period.
Cancellations Policy
- All cancellations must be immediately notified in writing, signed by the person who signed the Booking Form.
- When the cancellation happens more than 5 weeks before the start of the rental period:
The initial deposit is not returned to the guest (the reservation deposit is non-refundable according to Bookings and Payments, number 2 in this Terms and Conditions – see above). - If the cancellation is within 5 weeks of agreed arrival date:
Then the full balance remains due and is not refundable. We return only the breakages deposit. - We recommend that the Guest undertakes travel insurance including provision for cancelations. When this does not take place the guest accepts responsibility for any loss that he / she may incur due to his / her cancellation.
- We don’t cancel the booking except in exceptional circumstances beyond our control. We notify cancellations as soon as possible and refund all payments. Any liability for cancellation is limited to payments previously made.
Identification Requirements
- Since 2015 Portugal has more strictly enforced a long-standing law. Anyone providing paid holiday accommodation must record the entry, exit, and identification details of all non-Portuguese nationals using that accommodation.
- The implementation of the 1990 Schengen Agreement aims to stop human trafficking and other illegal practices. In this case, it is specifically Article 45 of the Schengen Agreement and the recent Alojamento Local law in Portugal that has brought this rule into sharper focus.
- The governing body monitoring foreigners movement is SEF (Serviço de Estrangeiros e Fronteiras or the Immigration and Borders Service).
- Short-term rentals are required to report guest’s information to SEF within 3 days of your arrival.
- We collect this information when you fill our Booking Form. We will then verify your documentation when checking-in.
Facilities
- We provide a manual covering the facilities. Find very important information inside (e.g. how to deal with the rubbish and touristic information).
- The Guest is liable for any damage caused by not following the instructions’ manual.
- An Internet connection is available, subject to technical availability.
- TV, washing machine, fridge/freezer, shower, toaster, CD/ DVD players and other household equipment cannot be guaranteed. If an item fails we will make every effort to repair or replace it as soon as possible.
- We are not liable for any temporary defect or malfunction of equipment, machinery or appliance in the building or grounds.
- We provide bed linen and towels free of charge. Please bring your own beach towels.
- During the rental period we do not provide a cleaning service.
Complaints
- Any problems or complaints must be immediately reported according to the Terms & Conditions.
- We do not consider any complaints not reported to us during the rental period. In fact, when the Guest denies us the opportunity to put matters right during the rental period, he waives all rights of redress.
Obligations of the Guest :
- Supervise their children’s safety and behaviour at all times.
To put it in another way, the Guest is responsible for looking after their own children regardless of them being in the property, swimming pool, grounds or any other area in the development. - During the rental period and on departure, to ensure no valuable items are left in the patio (e.g. chairs). In addition, ensure that all windows and doors are securely locked.
- Take good care of the property during the rental period and leave it in a clean and tidy condition on departure.
We cancel the booking without notice if the Guest:
- Exceeds the apartment’s capacity of 4 people (unless if this was previously agreed when booking).
- Does not include all members’ names and information on the Booking Form.
- Gives access to the property, swimming pool and grounds to people not named in the Booking Form.
- Gives part with possession of the property. Including, sharing it (even at no charge) with others than the ones mentioned in the Booking Form.
- Sells or transfers the booking to another party without our agreement.
- Causes an annoyance or becomes a nuisance to the neighbours. This includes not respecting the quiet hours (10PM-8AM).
- Behaviour is unreasonable, impairs the enjoyment, comfort or health of others.
- Undertakes parties in the property or anywhere in the development.
Extra costs
- The Guest must immediately inform us of any losses or damages to the property. Thus giving us the opportunity to replace or repair items prior to the arrival of future guests.
If the repair/replace cost overcomes the breakages deposit, the guest is responsible to pay the difference. - The Guest covers locksmith costs in the event of lost or not returned keys.
- If the guest leaves the property in an unacceptable condition, he pays the difference between the breakages deposit and the additional cleaning costs.
Smoking
- We do not permit smoking in the property or patio.
- Smoking anywhere on the premises results in immediate termination of occupancy and forfeiture of all payments.
- The Guest pays the cost for any repair, damage or extra cleaning caused by smoking in the property.
Information for smokers:
Litter bins are available in the grounds or surrounding area. Use them to dispose of extinguished cigarette butts.
Pets
- We do not allow pets in the property.
Personal Belongings
- We return personal belongings.
However, the Guest pays the cost of postage, packaging and an administration fee. - Any personal items found at the property are disposed of within 30 days if not claimed.
- All food left behind is disposed of at the time of the changeover.
Liability
- The use of the accommodation, equipment and any other amenities on site is entirely at the guests’ risk. Moreover, we do not accept responsibility for injury, loss or damage, to the guests personally, or to their belongings (including vehicles).
- We are not liable for any temporary defect or stoppage in the supply of public services to the property.
